Who you buy from
You buy from DELTAHUB Inc., 450 7th Avenue, Suite 2710, New York, NY 10123, United States ("we", "us"). Orders shipped from Slovenia are fulfilled on our behalf by DELTAHUB d.o.o., Iršičeva ulica 5, 3000 Celje, Slovenia, registration 8556199000. Our online store runs on Shopify. Our full details are in our legal notice.
What these terms cover
These terms apply when a consumer buys from us on deltahub.io. Business customers who buy through our B2B portal have separate terms. Browsing our site does not by itself bind you to these sales terms. They apply to your purchase when you place an order.
You must be old enough to make a binding contract where you live, or have the permission of a parent or guardian.
How your order becomes a contract
- You choose your products and go to checkout.
- You review your order, shipping cost, taxes and duties, and correct any errors.
- You place the order by pressing the button that confirms it and commits you to pay.
- We send a confirmation email. The contract forms when we send that email.
We keep your order details and you get them in the confirmation email. These terms are in English. You can save or print this page.
We may decline or cancel an order only if the item is unavailable, the price has an obvious error, we suspect fraud, or we cannot deliver to your address. If we do, we tell you and refund what you paid without delay.
Prices and taxes
The price, shipping cost, and any taxes and duties are shown at checkout before you pay. The price that applies is the one you see when you place your order. Our shipping policy explains what is included for each destination. Product descriptions are part of what we promise you. Colors can look slightly different depending on your screen.
Payment
You can pay with the payment methods shown at checkout. Your payment is handled by our payment providers.
Delivery
Our shipping policy sets out where we ship from, rates, delivery estimates, lost parcels and your delivery rights. It is part of these terms.
Changing or canceling an order
You can cancel or change an order until the warehouse has started on it. We cannot promise this, so please write straight away. Once an order has shipped, we cannot change or stop it, but you can use our 60-day returns.
Preorders can be canceled any time before they ship. Our 60-day returns apply after delivery.
Returns and withdrawal
Our refund policy sets out our 60-day returns and is part of these terms. It also explains the separate 14-day legal right to withdraw or cancel for consumers in the EU, EEA and UK. You can use that right online at https://deltahub.io/pages/withdrawal.
Warranty and legal rights
Our warranty page sets out your legal rights and our 2-Year Limited Warranty. It is part of these terms.
Digital products
When you buy a digital product, such as a wallpaper or a 3D file, we give you a license to use the files for personal use only. You may not share, upload, sell or redistribute the files, use them commercially, or modify them without our written permission, unless the product page allows it. For example, a product page may allow you to print and use a 3D file. We keep all other rights in the files. Our refund policy explains your rights if a file is faulty and when digital purchases can be returned.
Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, for gross negligence or willful misconduct, or under product liability law. Nothing in these terms excludes or limits your statutory consumer rights.
The next sentence does not apply to consumers in Quebec. Subject to the paragraph above, we are not liable for loss that was not reasonably foreseeable.
Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Reviews and things you send us
You keep your rights in your reviews. You can post honest reviews, including negative ones. We only remove reviews that are unlawful, private, abusive, off-topic or clearly false. We collect reviews through third-party services. Unless a review is labeled to say otherwise, we do not claim that it comes from someone who bought the product.
Using our site
Please do not use our site for anything unlawful, try to break its security, upload malicious code, or copy our content for commercial use without our permission. We may block access to the site for someone who does. Our site may link to other websites, which have their own terms. We may change or update the site. This does not affect orders you have already placed.
Changes to these terms
We may update these terms for future orders. The terms in force when you placed your order apply to that order.
Complaints
If something has gone wrong, email support@deltahub.io. Most replies come within one business day. We are not obliged to use, and do not currently use, an alternative dispute resolution body. Consumers in the EU can find help at their European Consumer Centre.
Law and courts
If you are a consumer, you also benefit from the mandatory provisions of the law of the country where you live, and nothing in these terms affects your right to rely on them.
- EU, EEA and all countries not listed below: these terms are governed by the laws of Slovenia. If you live in the EU or EEA, you may bring a claim in the courts of your home country, and we can only sue you there.
- United States: these terms are governed by the laws of the State of New York.
- United Kingdom: these terms are governed by the laws of England and Wales. You may bring a claim in the courts of the part of the UK where you live.
If part of these terms is invalid
If a court finds part of these terms invalid, the rest still applies.
